Elder Abuse

Is a caregiver assaulting your parent at an assisted living facility? Is a family member taking pension payments from your great aunt? Elder abuse refers to the neglect, exploitation or “painful or harmful” mistreatment of anyone who is 65 or older (or anyone aged 18 to 64 who falls under the legal definition of a “dependent adult”). Elder abuse can take many forms, which result in resulting physical harm or pain or mental suffering:

  • Physical Abuse —the infliction of physical pain or injury on an elder or dependent adult, e.g. slapping, bruising, or restraint by physical or chemical means.
  • Emotional Abuse—inflicting mental pain, anguish, or distress on an elder or dependent adult through verbal or nonverbal acts, e.g.., intimidating or threatening verbal assaults; subjecting an individual to fear, isolation, or serious emotional distress; withholding of emotional support; confinement
  • Sexual Abuse—non-consensual sexual contact of any kind on an elder or dependent adult.
  • Abandonment—the desertion or willful forsaking of an elder or a dependent adult by anyone having care or custody of that person under circumstances in which a reasonable person would continue to provide care and custody.
  • Isolation— acts intentionally committed for the purpose of preventing an elder or dependent adult from receiving his or her mail, email, texts, internet communications or telephone calls; or falsely telling a caller or prospective visitor that an elder or dependent adult is not present, or does not wish to talk with the caller, or does not wish to meet with the visitor for the purpose of preventing the elder or dependent adult from having contact with family, friends, or concerned persons; or false imprisonment of an elder or dependent adult; or physical restraint of an elder or dependent adult for the purpose of preventing the elder or dependent adult from meeting with visitors.
